  1. OVERVIEW

These Terms of Service govern your use of shoporynta.com and purchases made from ORYNTA.

“ORYNTA,” “we,” “us” and “our” refer to the operator of this online store. By visiting our website, creating an account or placing an order, you agree to these Terms and the policies linked on our store.

If you do not agree to these Terms, you must not use the store.

  1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your place of residence or have permission from a parent or legal guardian to use this store.

You are responsible for providing complete, accurate and current account, billing, payment and delivery information.

You are responsible for protecting your account credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without permission.

  1. PRODUCTS

We aim to describe and display ORYNTA products accurately. Product colours may appear differently depending on your screen, lighting and device settings.

Product measurements, capacities, weights and performance descriptions are approximate unless expressly stated otherwise. Minor variations may occur between manufacturing batches.

ORYNTA drinkware must be used and cared for according to the supplied instructions. Product information on our store is not medical advice.

We may update product information, correct errors, limit quantities or discontinue products when reasonably necessary.

  1. ORDERS

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or dispatch the order, subject to applicable law.

We may reject or cancel an order because of:

• Payment failure
• Suspected fraud or unauthorised activity
• Stock unavailability
• Pricing or product-description errors
• Delivery restrictions
• Legal or regulatory requirements

If we cancel an order after receiving payment, we will refund the amount paid.

Review your order carefully before submitting it. We cannot guarantee changes or cancellations after fulfilment has started.

  1. PRICES, CURRENCY AND PAYMENT

The price and currency payable are displayed during checkout before you complete your order.

Any approximate currency conversion displayed elsewhere on the website is provided for convenience only. The final exchange rate and any foreign-transaction charge may be determined by your bank or payment provider.

You authorise the payment provider selected during checkout, including PayFast where available, to process the total amount shown.

Applicable shipping charges, taxes and other charges will be displayed during checkout where available.

  1. SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.

ORYNTA uses third-party sourcing, fulfilment and delivery providers. Products may be dispatched from different facilities and items from one order may arrive separately.

Delivery dates are estimates unless applicable law requires otherwise. We are not responsible for delays caused by carriers, customs authorities, incorrect delivery information or events outside our reasonable control.

Nothing in this section limits any mandatory consumer rights relating to delivery, loss or non-delivery.

  1. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges, cancellations and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

Nothing in these Terms removes any consumer right or remedy that cannot legally be excluded.

  1. PROMOTIONS AND DISCOUNTS

Promotions, discount codes and special offers may be subject to additional conditions.

Unless stated otherwise:

• Discounts cannot be combined
• Discount codes have no cash value
• Promotions apply only during the advertised period
• Promotions may be changed or withdrawn before an order is placed

  1. ACCEPTABLE USE

You may use the store only for lawful shopping and informational purposes.

You must not:

• Commit or attempt fraud
• Provide false or misleading information
• Access another person’s account without permission
• Introduce viruses or malicious code
• Interfere with store security or operation
• Collect personal information without authorisation
• Copy, scrape or exploit store content without permission
• Use the store in violation of applicable law

We may restrict or suspend access where reasonably necessary to protect customers, ORYNTA, Shopify or our service providers.

  1. INTELLECTUAL PROPERTY

The ORYNTA name, logos, product imagery, written content, graphics, videos and store design are owned by or licensed to ORYNTA and are protected by applicable intellectual-property laws.

You may use the store for its intended purpose. You may not reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission.

  1. REVIEWS AND SUBMISSIONS

You must own or have permission to submit any review, photograph, video or other content you provide.

By submitting content, you grant ORYNTA a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it for operating, improving and promoting the store.

You must not submit unlawful, misleading, defamatory, abusive or rights-infringing content. We may remove content that violates these Terms.

  1. THIRD-PARTY SERVICES AND LINKS

The store may use or link to services operated by third parties, including payment, fulfilment, delivery, analytics and social-media providers.

Those providers may have their own terms and privacy policies. ORYNTA is not responsible for third-party websites or services that we do not control, subject to any liability that cannot legally be excluded.

  1. RELATIONSHIP WITH SHOPIFY

ORYNTA is powered by Shopify, which provides the technology used to operate the online store.

Purchases made through the store are transactions directly between you and ORYNTA. Shopify is not the seller of ORYNTA products and is not responsible for fulfilling ORYNTA orders.

  1. ERRORS AND AVAILABILITY

We may correct typographical errors, inaccurate descriptions, incorrect prices, promotions, delivery charges or availability information.

If an error affects an order you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

  1. WARRANTIES AND CONSUMER RIGHTS

Products and services are supplied subject to all warranties, guarantees and remedies that cannot legally be excluded.

To the fullest extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free or available.

No wording in these Terms excludes mandatory product-quality, safety, delivery, refund or other consumer protections applicable to you.

  1. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

To the fullest extent permitted by law, ORYNTA is not responsible for indirect or consequential losses that were not reasonably foreseeable when the agreement was made.

  1. TERMINATION

You may stop using the store at any time.

We may suspend or terminate access where you violate these Terms, misuse the store, engage in fraud or create a security or legal risk.

Terms that by their nature should continue after termination—including intellectual-property, liability and dispute provisions—will remain effective.

  1. GOVERNING LAW AND CUSTOMER PROTECTION

These Terms are governed by the laws of South Africa because ORYNTA is operated from South Africa.

This does not deprive customers in the United States, European Economic Area or United Kingdom of mandatory consumer protections that apply in their location.

Before beginning formal proceedings, please contact us so we can attempt to resolve the matter. Customers may also use any regulator, tribunal, dispute-resolution service or court available under applicable law.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our services, business practices or legal requirements.

The revised Terms will be posted on this page with a new “Last updated” date. Material changes will be communicated where required by law.

Changes apply prospectively and do not remove rights that have already arisen under an accepted order.

  1. GENERAL TERMS

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision is not a waiver of that provision.

These Terms, together with the policies referenced in them, constitute the agreement between you and ORYNTA regarding use of the store and purchases made through it.
